ATO denied access to family law documents

You will recall that I recently posted a a blog post from my colleagues at View Legal regarding the ATO gaining access to documents filed in family law proceedings.

View Legal have reviewed another recent case where the ATO was denied access to documents filed in family law proceedings, this time by a judge of the Federal Court of Australia.

In International Litigation Partners Pte Ltd v FCT [2014] FCA 671 the Federal Court considered whether the ATO should be able to gain access to documents and set out 4 main issues that must be considered.  The Court ultimately found that the ATO could not use the documents.

With thanks to the team at View Legal, you can access their blog post here.
